ENSPACE General Terms and Conditions

These General Terms and Conditions (GTCs) shall govern all agreements between ENSPACE GmbH (FN 613853 a) with an address at Office Park 2, 1300 Wien-Flughafen, Austria (ENSPACE), on the one hand, and the customer (Customer), on the other hand. The Customer and ENSPACE are each referred to herein as a Party.

A contract shall be concluded by accepting the offer prepared by ENSPACE through signing by the Customer or by filling in an registration form for one of ENSPACE’s events or services on ENPACE’s website https://enspace.com/.

ENSPACE’s offers shall be valid for three months from the issue date.

All contractually agreed remuneration shall be in euro plus applicable statutory value added tax, unless stated otherwise.

After Customer’s registration for an ENSPACE event or service they will receive a confirmation by e-mail within the next 3 working days. Customer will receive the invoice incl. VAT also by e-mail.

Transfer of Customer’s participation fee has to be effected in full to ENSPACE’s bank account at least 14 days before the first day of the respective ENSPACE event or service. If Customer can only pay on short notice, they are obliged to bring the payment confirmation to the event venue.

The participation fee usually covers full catering and documentation of the presentations. Details can be found on the registration page of the respective event.

If for any reason Customer is not able to participate in the booked ENSPACE event or service, they can upon notification nominate another person to attend in their place. In case of a substitute, Customer is obliged to notify ENSPACE in writing via e-mail.

If Customer cannot find a substitute attendee / In the case of cancellations:

• between 60 and 90 days before the event 30%
• between 30 and 60 days before the event 50%
• less than 30 days before the event 100%

of the contract value shall be charged.

In case of cancellation on the part of ENSPACE, e.g. due to an insufficient number of participants, Customer will receive a refund immediately.

Unless otherwise agreed in writing, in the event of cancellation on the part of Customer: 

• up to 6 months before the event a cancellation fee of 20 % is due to be paid by the sponsoring partner (Customer). 
• From 6 to 3 months before the event 50 % are due, 
• and 3 months or less before the event, 100 % are due.

During ENSPACE’s events, photographs and/or videos may be recorded by ENSPACE or on its behalf. By registering for an event, Customer acknowledges that photographs and video material in which they are depicted may be used for press coverage and be published in a variety of media including social media, publications and ENSPACE websites. Customer may revoke this consent at any time.

The relevant paragraphs from both Austrian commercial code (HGB) and Austrian civil code (ABGB) in their respective valid versions apply. Place of performance and jurisdiction is Schwechat, Austria.

Any disputes arising out of or in context of a relationship governed by these GTCs shall be governed by Austrian Law.

Any disputes relating to these GTCs shall be subject to the exclusive jurisdiction of the respective courts of Austria.
